Medical malpractice

Medical malpractice lawyer in Dallas

When care causes harm, the questions are medical and the deadlines are legal. We work through both with you.

Not every bad outcome is malpractice. Medicine carries risk, and a treatment can fail even when everything is done right. Malpractice is narrower: a doctor, nurse, hospital, or other provider fell below the accepted standard of care, and that caused the injury.

That difference is why these cases move slowly and carefully. Health care claims have strict rules of their own. They can include written notice before a lawsuit and support from a qualified medical expert early in the case. Missing a step can end a claim, however strong the facts.

Shayan Elahi reviews each matter himself, starting with the records and the dates.

Malpractice claims we review

How a malpractice claim moves

These cases are decided by the records. So that is where we start.

  1. Review the timeline.

In the case review, we go through what happened, when, and who provided the care. The dates set the deadlines, and they can be tighter than in other injury cases.

  2. Get the records.

Complete medical records from every provider involved, including the ones you were not shown at the time.

  3. Medical review.

A qualified physician or other expert reviews whether the care met the standard and whether that caused the harm. Without that support, a claim usually cannot go forward.

  4. Notice and presuit steps.

Before a lawsuit, the law usually requires written notice to each provider, and sometimes a medical authorization or a presuit investigation.

  5. Negotiate or file.

Some claims resolve after notice. Others are filed and move into expert reports and discovery. You decide each step with the risks in front of you.

Medical malpractice questions

Is every bad outcome malpractice?

No. Medicine carries risk, and a treatment can fail even when everything is done right. Malpractice means a provider fell below the accepted standard of care, and that caused the injury.

This is general information, not legal advice.

How long do I have to file?

Often 2 years, counted from the treatment or from when the harm was found, depending on the law that applies. Most claims also have an outer limit, and exceptions apply, including for children. Sending the required notice can extend some deadlines.

This is general information, not legal advice. Your deadline depends on your facts.

Is there a limit on what I can recover?

It depends on the law that applies to your claim and the kinds of loss involved. We explain what can limit recovery in your case at the case review.

This is general information, not legal advice.

Why do I need a medical expert?

Health care claims usually need a qualified medical expert early in the case, explaining how the care fell short and how that caused the harm. Without that support, a court can dismiss the claim. That is why we review records with a medical expert before filing.

This is general information, not legal advice.

What should I do now?

Request copies of your medical records and keep every bill and letter. Write down dates, names of providers, and what you were told. Do not sign anything from the provider or its insurer about the treatment before you speak with a lawyer.

This is general information, not legal advice.
