Car accidents

Car accident lawyer in Dallas

We sort out the insurance, keep track of the deadlines, and plan each step with you while you recover.

A crash takes seconds. The paperwork takes months. There is a police report to get, at least two insurers to deal with, a car to repair, and medical bills that arrive before anyone has agreed who pays them.

Texas is an at-fault state. The driver who caused the crash, and that driver’s liability insurer, pay for the harm. Proving fault, and finding every policy that applies, is most of the early work.

Texas clients meet at our Dallas office on LBJ Freeway. Florida clients meet with Shayan by phone or video. There is no Florida office.

How a car accident claim moves

The insurer has a plan for your claim on day one. So should you.

  1. Read the board.

In the case review, we go through the crash, your injuries, and the date. In Texas, we ask for the crash report (form CR-3) if police wrote one.

  2. Find every policy.

The other driver’s liability coverage is the start. Your own uninsured motorist, personal injury protection (PIP), or medical payments coverage may also apply. In a rideshare crash, the company’s policy may too.

  3. Anticipate the adjuster.

Adjusters look for gaps in treatment, earlier injuries, and statements that shift fault. We plan for those questions before the insurer asks them.

  4. Document the loss.

Medical records and bills, proof of missed work, repair estimates, and a record of how the injuries affect daily life.

  5. Demand, negotiate, or file.

We send a written demand when the full cost is clear. If the insurer’s offer does not match the records, you choose whether to file suit, and we explain the trade-offs before you do.

What should I do right after a crash?

Get medical care first, even if the pain seems minor. Call the police so there is a report. If you can, photograph the vehicles, the road, and your injuries, and get the names and numbers of witnesses. Report the crash to your own insurer. Before you give a recorded statement to the other driver’s insurer, talk to a lawyer.

How long do I have to file?

In Texas, usually 2 years from the crash, under Civil Practice and Remedies Code section 16.003. In Florida, usually 2 years for crashes after March 24, 2023, under Florida Statutes section 95.11(5)(a). Older Florida crashes may fall under the old 4-year rule. Claims against a government vehicle in Texas can need notice within 6 months (section 101.101).

What if the other driver has no insurance, or not enough?

Your own uninsured or underinsured motorist coverage may pay. In Texas, insurers must offer this coverage, and it applies unless you rejected it in writing. Check your policy declarations page and bring it to the case review.

Who pays my medical bills while the claim is open?

Usually your own coverage first. In Texas, that may be PIP, which insurers must offer unless you rejected it in writing, or your health insurance. In Florida, PIP is required, and you generally must get initial treatment within 14 days of the crash to use it. The at-fault driver’s insurer usually pays only at settlement.

This is general information, not legal advice. Your deadline depends on your facts.

What if the driver was working for Uber or Lyft?

The coverage depends on what the app showed at the moment of the crash: offline, waiting for a ride request, or carrying a passenger. Each status points to a different policy. Screenshots and trip receipts help.

How much does it cost to hire you?

Fees depend on the case. We explain the fee in writing before you hire us.
