Mediation and ADR

Mediation and ADR lawyer in Dallas

Business and family disputes settled at a table, in private, on terms the people involved agree to.

Not every dispute needs a courtroom. Mediation puts both sides in a room, or in separate rooms, with a neutral person whose job is to help them reach terms they can both sign. Nobody is forced to agree.

It is usually faster and cheaper than a trial. It is private. And the people who know the dispute best decide the outcome, instead of a judge or jury.

Elahi Law handles mediation for business disputes and family matters, and arbitration.

Texas clients meet at our Dallas office on LBJ Freeway. Florida clients meet with Shayan by phone or video. There is no Florida office.

Business mediation

For owners, partners, customers, vendors, and landlords who would rather settle than sue.

Family mediation

For families who want to make decisions together, not have them made by a court.

  • Divorce
  • Child custody and visitation
  • Child support and spousal support
  • Division of property

In family matters Shayan serves as the neutral mediator, not as attorney for either spouse.

Shayan’s role

He is neutral. He does not represent either side or give either side legal advice. His job is to keep the conversation moving, test each proposal against reality, and write down the terms the parties agree on.

How a mediation moves

A good mediation is mostly preparation. The day itself is the last few moves.

  1. Agree to mediate.

Both sides agree, or a court orders it. Many Texas courts send civil and family cases to mediation before trial.

  2. Prepare the position.

Each side gathers the key documents and decides what matters most. Knowing your priorities, and the other side’s, is most of the work.

  3. The session.

Usually one day or less. The mediator meets with both sides, together or apart, and carries proposals between them.

  4. Write it down.

If the parties agree, the terms go into a signed settlement agreement. If they do not, nothing said in mediation can usually be used later in court, and the dispute goes back to its other options.

What is the difference between mediation and arbitration?

A mediator helps the two sides reach their own agreement and decides nothing. An arbitrator hears both sides and makes a decision, which is usually binding, much like a judge. Mediation keeps the outcome in your hands. Arbitration hands it to a neutral.

This is general information, not legal advice.

Is a mediated agreement binding?

Once both sides sign a written settlement agreement, it can be enforced like a contract. In Texas family cases, a mediated settlement agreement that meets the Family Code’s requirements is binding and cannot be withdrawn later. It must say so in a prominent statement and be signed by the parties and any attorneys present.

This is general information, not legal advice.

Is mediation confidential?

In Texas, what is said in mediation is generally confidential and cannot be used as evidence later, with some exceptions.

This is general information, not legal advice.

How long does it take?

Many mediations finish in a single session of a few hours to a full day. Complex business or family matters may need more than one session. Either way, it is usually much shorter than a lawsuit.

This is general information, not legal advice.

What if we do not reach an agreement?

Nothing is lost. The dispute goes back to its other options: more negotiation, arbitration, or court. Most people leave with a clearer view of the other side’s position, which helps whichever route comes next.
