Mediation and ADR Case FAQs
Mediation is a voluntary and collaborative process where a neutral mediator helps disputing parties reach a mutually acceptable resolution. Arbitration, on the other hand, is a more formal process where an arbitrator listens to both sides and makes a binding decision, similar to a court ruling.
Mediation itself is not automatically legally binding, but if both parties agree on a resolution, they can sign a settlement agreement that is legally enforceable. This provides flexibility while ensuring compliance.
Mediation can often be resolved in a few hours or sessions, depending on the complexity of the dispute and the willingness of both parties to negotiate. It is generally much faster than traditional litigation.
Mediation is effective for a wide range of disputes, including business disagreements, employment conflicts, contract disputes, family law matters, real estate issues, and personal injury cases.
If mediation does not lead to a resolution, the parties may choose to pursue arbitration, litigation, or another form of dispute resolution. However, mediation often helps clarify issues and improves future negotiations.
Mediation is generally far more cost-effective than litigation, as it reduces legal fees, court costs, and the time spent on lengthy legal battles. It also helps parties maintain better relationships by avoiding adversarial courtroom proceedings.
